A fish in a geothermal fissure
The Devils Hole pupfish, Cyprinodon diabolis, lives in the smallest known habitat of any vertebrate animal on Earth. The entire species is confined to the top 24 meters of a single, water-filled limestone cavern in the Mojave Desert. Its survival depends entirely on a shallow, submerged rock shelf near the surface, measuring just 3.5 by 5 meters, where it feeds and spawns. This geothermal pool is a detached unit of Death Valley National Park, located within Nevada's Ash Meadows National Wildlife Refuge.
The water maintains a constant temperature of about 33-34°C (91-93°F) and has very low levels of dissolved oxygen, conditions that would be lethal for most other fish. The pupfish itself is tiny, averaging just 2.5 centimeters in length. Males are an iridescent blue, while females are more yellow-olive. A distinct trait is the complete absence of pelvic fins. Their diet consists of the limited resources available on the spawning shelf, primarily algae and diatoms. The lifespan of a Devils Hole pupfish is short, typically only 10 to 14 months. Population counts, conducted since 1972, show extreme fluctuations. Before the mid-1990s, the population hovered between 200 and 500 individuals. It later fell to a historic low of just 35 fish in 2013, but has seen recent highs, including 263 pupfish in autumn 2022.
From desert spring to the Supreme Court
In the late 1960s, large-scale agricultural operations began pumping groundwater from the aquifer that feeds Devils Hole. The water level in the cavern dropped, threatening to expose the critical spawning and feeding shelf. This led to a landmark legal battle. President Harry Truman had designated Devils Hole a unit of the Death Valley National Monument in 1952 to protect its unique scientific value. The federal government sued the ranchers, the Cappaert family, to halt the pumping.
The case, Cappaert v. United States, reached the Supreme Court in 1976. The court ruled unanimously that when the government set aside the land in 1952, it implicitly reserved the water rights necessary to fulfill the purpose of the reservation. In this instance, that purpose was the preservation of the pupfish and its habitat. The ruling established a minimum water level, forcing the Cappaerts to limit their pumping. This decision set a powerful precedent, affirming that federal reserved water rights could apply to groundwater and were superior to later claims made under state law. Today, a high-security fence protects the site from vandalism, and scientists at the nearby Ash Meadows Fish Conservation Facility maintain a captive refuge population in a full-scale replica of the habitat to safeguard the species against extinction.
